What changes for e-commerce sites with Hamon Law?

A sector of Hamon Law is going to impose some modifications on the online shops of the storekeepers.

1) First of all, let’s talk about the cooling-off period. The cooling-off period without motive passes now during 14 days from the article reception. On that purpose, the e-storekeeper will owe:

 

  •          Upload on-line a form of "readable and understandable" retraction, which is available to the customer.

  

  •          Send an acknowledgement of receipt of the buyer retraction.

Pay attention, certain articles are not concerned by the right to withdraw, in particular the physical hygiene products.

2) With term of redemption returned during 14 days, the e-storekeeper will have to give a refund with the same means of payment which the buyer (or another one with the agreement of the buyer and without additional costs).

3) With this reform, it is necessary to know that disclosure obligations are strengthened. Among the new obligations, the e-storekeeper will owe:

 

  •          Affix clearly the obligation for payment at the purchase time. A sentence such as: "I understand that make this order requires a payment" can do to avoid any ambiguity to this question.

  

  •          Post the relative information to the product and the trader. The contact information must be supplied on the site before and while- order. The buyer must be informed that the expenses of return are at the responsibility with an estimation of these expenses.

 

  

  •          Post the code of conduct followed by the storekeeper (Fevad, SNCD or even UFMD…).

   

  •          Post means of payment accepted on the site and at the latest time of the order.

  

  •          And good news, stop in the pre-marked compartments!! More insurance or additional products are bought unintentionally.

4) Another point concerns guarantees and an excellent piece of news for the consumers. Now, when an article does not work any more, it is possible to be under guarantee 24 months after the product purchase (we thus pass from 6 to 24 months).

For all the owners of an online shop, it is now for you to play! Other elements are studied with this reform, in particular the possibility of practicing a discount of the product further to a dismissal of this one (but where it remains fuzzy that attributes to this discount).
